PARTNER VISA (Pareja de Hecho)
SPAIN
A flexible and efficient pathway for non-EU partners to obtain Spanish residency — without marriage.
"Pareja de Hecho" is Spain’s legally recognised civil partnership, enabling non-EU partners of Spanish/EU citizens to obtain residency with the same rights as married couples, without legally marrying.
It is one of the fastest, simplest and most cost-efficient family-reunification routes in Spain.
What Is “Pareja de Hecho”?
“Pareja de Hecho” is the legal recognition of a stable and committed relationship between two partners in Spain.
This residency pathway is commonly used when one partner is:
-
A Spanish citizen
-
An EU/EEA citizen
-
A Spanish Permanent Resident or Long-Term Resident
Once the relationship is officially registered, the non-EU partner may apply for the EU Family Member Residence Card (“Tarjeta de Familiar de Comunitario”).
How Can a Stable Relationship Be Proven?
Requirements vary depending on the autonomous region in Spain, but authorities commonly look for evidence such as:
-
Living together at the same address
-
Joint padrón (address registration)
-
Joint rental agreement or shared property ownership
-
Shared bank account or financial commitments
Many regions require couples to demonstrate cohabitation for approximately 6–12 months before registration, although some regions may have different rules or exemptions.
Key Benefits of the Residence Card
The residence card grants the non-EU partner:
-
Legal residency in Spain
-
Full rights to work and live in Spain
-
Freedom to travel throughout the Schengen Area
-
Access to public healthcare, education, and social benefits
-
A pathway towards Permanent Residency and Spanish citizenship
In many cases involving Spanish or EU citizens, applicants may receive a residence card valid for up to 5 years from the initial approval.
After 5 years of legal residency, applicants may become eligible for Permanent Residency, and after 10 years, they may apply for Spanish citizenship, subject to eligibility requirements.
Eligibility Requirements
Requirements vary slightly depending on the autonomous region in Spain, but the core criteria generally include the following:
1. Genuine Relationship Requirement
Applicants must demonstrate a real and ongoing relationship.
Typical supporting documents may include:
-
Joint rental agreement or property ownership
-
Shared padrón (address registration)
-
Joint bank account or shared financial evidence
-
Photos, travel records, or proof of long-term relationship
Most regions in Spain require proof of living together for approximately 6–12 months before registration.
2. Financial Requirement
The Spanish or EU partner must demonstrate sufficient and stable financial means to support the household.
Supporting documents may include:
-
Employment contract
-
Recent payslips
-
Bank statements
-
Tax returns
-
Autónomo (self-employed) registration and filings
3. Criminal Record Requirement
The non-EU applicant is generally required to provide:
-
Criminal Record Certificate(s) covering the previous 5 years
-
Spanish criminal record verification where applicable
All foreign documents usually need to be legalised/apostilled and officially translated into Spanish.
A Practical and Flexible Residency Route
For many international couples, Pareja de Hecho offers one of the most practical and flexible pathways to legal residency and full work rights in Spain without requiring marriage.
With proper preparation and documentation, it can provide a stable long-term route towards building a life together in Spain.
